IPS GP Singh No relief from from HC : Court refuses to stay arrest, Seeks response from government in 4 weeks

Suspended IPS of Chhattisgarh GP Singh appears to be getting a setback from the High Court, with the High Court refusing to grant him interim relief, dismissing the petition. Along with this, a reply has been sought from the government in 4 weeks.

Let us tell you that IPS GP Singh had demanded interim relief challenging the FIR registered in the disproportionate assets case. The matter was heard in the bench of Justice Rajni Dubey. The court had on Friday listed the matter as for Pronunciation of Judgment.

IPS GP Singh through his advocate Ashutosh Pandey has presented a new petition in the High Court. Challenging the disproportionate assets case against him, he has said that the government has not followed the legal process before the FIR. In this case the criminal case should be quashed. His lawyer told the court that prior to an FIR under Section 17(a), it is necessary to take permission from the General Administration Department. Similarly, permission was to be obtained from the Central Personnel Department too, but it was not done.

He took information from the Central Personnel Department and the Ministry of Home Affairs under the Right to Information Act, then it was found that the procedure had not been followed before taking action. Therefore, the petition has sought quashing of the FIR. Also, as an interim relief, a stay was sought on the FIR till the matter is heard. After this hearing on this matter on November 17, the bench of Justice Rajni Dubey had reserved the decision.
